S5(2) MARRIED WOMEN AND CHILDREN(MAINTENANCE) ACT 1950

Cases in which wife not entitled to allowance

(2) No wife shall be entitled to receive an allowance from her husband under this Act if she is living in adultery, or if, without any sufficient reason, she refuses to live with her husband.

FAQ- I am already living with another man and he has promised to marry me. Can I still ask for a Court Order asking my  husband  monthly maintenance?

The answer can be found in the world of the Chimpanzees. When lady leaves the main guy for a better mate, the previous partner is no more liable to protect or provide.
