ORDER 26 A SCA 1980- SUMMARY JUDGMENT
1(1) Where in an action to which this rule applies, a statement of claim has been served on a defendant the
plaintiff may, on the ground that the defendant has no defence to a claim included in the summons, or to
a particular part of such a claim,or has no defence to such a claim or part except to the amount on any
damages claimed, apply to the Court for judgment against that defendant.
It is utterly stupid for a Defendant to appear in Court with that innocent look on the face, when the Defendant had admitted to the debt in an earlier letter and now wants to dispute it. Go back to the lawyer and give him a hearty slap on the face for bringing you to this level.Now you got 2 bills to pay- of the plaintiff and that of the lawyer.
