DEFAMATION
UTUSAN MELAYU (MALAYSIA) BHD & ORS
V
TJANTING HANDICRAFT SDN. BHD & ANOR
It was no defence to show that the Defendants did not intend to defame the Plaintiffs if reasonable people thought that the language was defamatory of the Plaintiffs. There was recklessness in the publication of the article with total disregard as to whether the statements made were true or false. Therefore there was malicious intent on the part of the Defendants against the Plaintiffs as found by the trial judge.
