 Dismissal: Retrenchment- takeover by another Co- Issue as to who employers of Claimants were- W/R new Company obliged to keep Claimants employed

There were 3 main issues  that arose for consideration before this Court. 1st - to determine who the Claimants employers were. 2nd- to determine w/r the YTL Group was liable for the dismissal of the Claimants, and lastly to determine w/r the Claimants dismissal had been with just cause an excuse.

The veil of incorporation was lifted in this case.
