ORDER 26A - SUMMARY JUDGMENT

Manner in which an application under Rule 1 must be made - Order 26A r2

(1) An application under Rule 1 must be made by notice in Form 65 supported by an Affidavit in Form 75A verifying the facts on which the claim,or part of the claim, to which the application relates is based and stating that in the deponents belief there is no defence to that claim or part, as the case may be , or no defence except as to the amount of any damages claimed.

(3) A copy of the Affidavit in support and of any exhibits referred to therein must  be served on the defendant not less then 14 clear days before the return day.
