DISTRIBUTION ACT 1958 FAQ- 1

What is the legal situation if a person dies but  there is a wife but no children but no parent or parents?
if an intestate dies leaving a spouse and no issue and no parent or parents, the surviving spouse shall be entitled to the whole of the estate.

But this is only a general principle. If the property had been inherited by the man from his parents and the couple had only been married for a short time, then it does not automatically go to the wife. However those who claim to have an interest in the property must plant a caveat on the property immediately to prevent the spouse from disposing of the property immediately. You need to see a lawyer when faced with such a situation all.
