There are no specific provisions in the Contracts Act dealing with the principles relating to Invitation to Treat.The Malaysian Courts,in this regard,have followed English common law principles in this area of the law.In Coelho v Public Services Commission [1964] MLJ 12 HC, a distinction was drawn between between on affer and an ITT and the Court held an advertisement in a newspaper not to be an offer but merely an inviation to treat.
